The Oversight Project has filed this lawsuit to compel the DOJ to release transcripts of conversations between Hur and Biden. In a notable turn of events, President Biden has described Hur, now 81 years old, as a “well-meaning, elderly man with a poor memory.” Attorney General Merrick Garland has been resisting requests for the uncut video or audio productions of these interviews, arguing they could be used for political manipulation.
Recently, the DOJ informed the court about 117 pages of notes. These notes were taken by ghostwriter Mark Zwonitzer while preparing an autobiography about President Biden. These transcripts, in which Biden and his ghostwriter discuss classified material, were used by Hur to draw his conclusions.

The DOJ had previously stated in June that there was no written record of discussions between Biden and Zwonitzer. However, the emergence of these transcripts contradicts this claim. Now, the DOJ and the Oversight Project are in discussions to determine how much evidence can be made public.

Another assertion has strengthened the case. The state attorney general, whose precedent Garland used to claim executive privilege over the Biden-Hur tapes, has disagreed with Garland’s logic. Garland has been citing former AG Mukasey as his main precedent in protecting these tapes under Executive Privilege.
This all started after classified documents were discovered in President Biden’s Delaware home. This happened shortly after a search for equally classified documents in former President Donald Trump’s possession. Trump has been pointing to this incident as an example of what he perceives as bias by the Biden Justice Department.
Yet, last month, U.S. Florida District Judge Aileen Cannon dismissed the Trump case due to issues relating to the unlawful appointment of special counsel Jack Smith.
