In a recent incident on the New York City subway, a 24-year-old former Marine named Daniel Penny found himself at the center of a heated debate after he intervened to protect fellow passengers from a potentially dangerous situation. The altercation involved a 24-year-old homeless man, Jordan Neely, who had a history of mental health issues and over 40 prior arrests. Attorney Steve Raiser, representing Daniel Penny, shed light on the events that unfolded that day during an interview with Fox News host Judge Jeanine Pirro. According to Raiser, Neely had entered the subway car in an agitated state, swinging his arms and shouting aggressively. Passengers expressed concerns for their safety as Neely made alarming statements, expressing a disregard for potential consequences, including going to jail for life. This prompted Penny to take action to protect his fellow passengers.

Raiser emphasized that Penny’s mindset was solely focused on safeguarding the passengers from harm. The attorney stated that Penny feared for the safety of those on the train, as Neely’s behavior escalated with physical aggression and threatening gestures. Neely’s actions were perceived by passengers as potentially leading to a lethal outcome. Therefore, Penny, without considering the race or ethnicity of the passengers, decided to intervene, putting himself in harm’s way to protect everyone onboard.

The situation took an unexpected turn when Penny’s legal team learned that a grand jury would be impaneled swiftly to determine if charges should be brought against Penny. This expedited process caught them off guard, as they anticipated a more prolonged evaluation. Raiser expressed surprise at the sudden urgency and the need for Penny to surrender to the police the following day.

Addressing allegations of racial motivation, Raiser firmly dismissed such claims, stating that the facts do not support them. He stressed that Penny’s actions were not driven by race but by a genuine concern for the safety of his fellow passengers. Regardless of their racial or ethnic backgrounds, Penny endangered himself to protect all the individuals present on that subway car.

“None of that is based on the facts,” Raiser said. “As to race, it’s simply not the motivation for Danny. He is the one that put himself in danger, to save who? All the people on that train. Black people, brown people, white people, it didn’t matter to Danny. Danny put his life at risk to save all those people. It has nothing to do with race.”
