DA Facing Backlash After Decision

The tragic story unfolding in Reston, Virginia, is a chilling example of what happens when ideology is allowed to trump justice—and public safety pays the price. An illegal immigrant with a history of violent charges was released into the community, not once, but repeatedly, thanks to decisions made by officials who seem more interested in appeasing progressive orthodoxy than protecting the people they serve.

The suspect, Marvin Fernando Morales-Ortez, is not a first-time offender. He’s not someone accused of a nonviolent crime or in the country seeking asylum through legal channels. He is, according to court records, a violent repeat offender who should have never been allowed to remain in the community. Yet somehow, thanks to the actions of Fairfax County Commonwealth Attorney Steve Descano, he was.


Morales-Ortez has been charged with multiple serious crimes, including a first-degree murder charge in 2021. And yet, Descano’s office declined to prosecute. Not once. Not twice. But repeatedly—entering nolle prosequi orders that dismissed case after case, refusing to hold Morales-Ortez accountable for crimes dating back to 2020. Incredibly, on December 16 of this year, another nolle prosequi was entered, and Morales-Ortez was released again.

The result? Yesterday, he murdered another person.

This wasn’t an unforeseeable tragedy. It was a preventable disaster. Law enforcement sources confirm that Fairfax County refused to cooperate with ICE, ignoring detainer requests that could have transferred Morales-Ortez to federal custody. Instead, they let a known threat walk freely among the community—a man ICE explicitly labeled a “criminal illegal alien from El Salvador.”


Behind this failure is a pattern. Commonwealth Attorney Steve Descano is backed by progressive megadonor George Soros, part of a national movement that has pushed criminal justice reform to extremes—often at the expense of safety. And Fairfax County Sheriff Stacey Kincaid, who also refuses to honor ICE detainers, is reportedly being considered for a leadership position in the Virginia State Police under incoming Governor Abigail Spanberger.

What this reveals is not just a single lapse in judgment—it’s a systemic issue. When prosecutors and sheriffs refuse to enforce the law, when they decline to prosecute violent offenders, and when they turn a blind eye to immigration enforcement, the consequences are deadly. A community can only sustain so many unpunished crimes before the structure of law and order begins to erode.


And now, a family is grieving the loss of a loved one who should still be alive. Because someone in power decided ideology mattered more than accountability. Because the law was interpreted through the lens of politics rather than principle.
